Intellectual Data Publishes First Survey Report on Korean Companies' eDiscovery in Cross-Border Litigation

  • 148 respondents, including legal, compliance, and IP professionals at Korean companies with overseas operations
  • 61.5% of respondents with five or more cross-border litigation/dispute matters reported eDiscovery experience at their company

Intellectual Data, an eDiscovery company, has published the "2026 Survey Report on Korean Companies' eDiscovery in Cross-Border Litigation," which examines how Korean companies respond to cross-border litigation and disputes and their experience with eDiscovery.

The report analyzes survey data on cross-border litigation and dispute response and eDiscovery experience at Korean companies that operate overseas or are preparing to expand abroad. According to the company, it is the first industry report in Korea to quantitatively analyze the eDiscovery landscape of Korean companies through a survey.

The online survey was conducted from April to May 2026. It drew responses from 148 legal, compliance, and intellectual property (IP) practitioners and decision-makers at companies that have experienced, or may face, cross-border litigation or disputes. The report covers the number and types of cross-border litigation and dispute matters, law firm engagement approaches, and response challenges, as well as eDiscovery experience, use of eDiscovery service providers, and expected benefits of AI.

The survey found that the share of respondents reporting eDiscovery experience at their company tended to increase with the number of cross-border litigation and dispute matters. Among respondents who reported five or more such matters at their company in the past three years, 61.5% said their company had eDiscovery experience. This compares with 3.1% among respondents reporting no such matters and 29.7% among all respondents.

“We set out to understand how Korean companies respond to cross-border litigation, disputes, and eDiscovery based on actual survey data, and to provide baseline data the industry can refer to,” said Yongmin Cho, CEO of Intellectual Data. “We hope this report will serve as a useful reference for corporate legal teams and other stakeholders.”

The report is available in Korean and English, and the full report can be downloaded from the Intellectual Data website.

[Note] What is eDiscovery?

eDiscovery (electronic discovery) is the process, used in U.S. civil litigation and other proceedings, of preserving, collecting, reviewing, and producing electronically stored information such as emails and documents to the opposing party. This survey addresses eDiscovery in cross-border litigation and disputes and does not cover K-Discovery (the discovery-related legislation under discussion in Korea).
